Motion to Quash

In May 2024, felony charges were filed against former Adams Township Clerk Stephanie Scott and her attorney, Stefanie Lambert. Nearly two years later, both women are set to appear in Hillsdale Circuit Court for a pivotal pretrial motion hearing.

Counsel for Ms. Scott will present a Motion to Quash and Dismiss the remaining charges. The prosecution is expected to move to strike certain defense witnesses.

The Hillsdale District Court previously dismissed the felony count involving the alleged “concealed” election tabulator, ruling that the machine’s secure custody in a locked township office fell within the Clerk’s lawful responsibilities, despite the earlier views of the Michigan State Police and District Judge Megan Stiverson, who signed the search warrant.

Four felony counts remain. Each arises out of the Clerk’s statutory duty and constitutional authority to investigate anomalies in voter registrations. The charges stem from Ms. Scott’s decision to provide Electronic Poll Book data to her attorney for forensic review by cybersecurity expert Benjamin Cotton, who reportedly identified irregularities, including an 11.5% discrepancy between state and township records from the 2020 Adams Township election.

At its core, this case concerns whether elected township clerks may exercise the full duties and authority of their constitutional office, and what qualifies as a “lawful” directive from the Michigan Bureau of Elections.

Michigan election law is clear: clerks have both the power and the duty to investigate suspected illegal or fraudulent voter registrations. See MCL 168.520. Election records must also be preserved under MCL 168.811 and 52 U.S.C. § 20701.

Yet the Attorney General’s office maintains that a clerk who retains counsel to assist in such an investigation has thereby engaged in a criminal conspiracy.

The public is warmly invited to attend and observe these proceedings, particularly the arguments regarding the proper scope of Michigan election law and the authority of constitutional officers. Courtroom access is open to all.
